内容摘要:国内CR1/CR2/IR1/IR2签证概要说明,在美国居住的美国公民只能在其居住地所属地区移民服务中心提交CR/IR申请,称为国外CR1/CR2/IR1/IR2.

开始申请时,就要注意复印你所递交的各种材料,作为备份,以防申请材料遗失等意外情况。对所收到的各类收据等也要注意保管、复印(如果被要求寄原件,则复印一份留底)。

国内CR1/CR2/IR1/IR2签证概要说明:

CR1 美国公民结婚两年之内的配偶,21岁以下的未婚子女为CR2

IR1 美国公民结婚满两年的配偶,21岁以下的未婚子女为IR2

在美国居住的美国公民只能在其居住地所属地区移民服务中心提交CR/IR申请,称为国外CR1/CR2/IR1/IR2.

如果美国公民在中国工作或学习,有中国的居留证,可以在美国驻中国使领馆(北京,上海,沈阳,成都,广州)申请DCF Visa(Direct Consular Filing), 001上称为国内CR1/CR2 或 国内IR1/CR2(中文)/DCF(英文),请参阅"国内CR1/CR2/IR1/IR2签证指南".

CR1/IR1/DCF为移民签证,入境美国后,4-8周内,即可在美国的家中收到移民局寄出的两年条件绿卡(结婚日到入境日不满两年的)/ 十年绿卡(结婚日到入境日超过两年的).

CR1在面签前或面试时,结婚满两年,移民官会自动将您的CASE由CR1转为IR1,则意味着您入境后一定是拿十年绿卡。CR1在入境时结婚满两年,入境处的移民官不一定会签发十年绿卡,可能是两年条件绿卡,此时需要您及时向移民官争取,如果没有说服移民官,仍然签发的是两年条件绿卡,入境后可向移民局申请换发十年绿卡。

孩子:

美国公民可同时单独为您的孩子(美国公民的继子女)申请CR2/IR2签证,但以下情况不能申请签证,只能等您入藉成为美国公民后,才能由您自己为孩子及其配偶和孩子申请F1/F3签证,您LG不能为您的孩子申请任何签证:

a. 您与美国公民结婚时,孩子超过18岁。

b. 申请时孩子超过21岁。

CR1/IR1不能自带CR2/IR2, 需要单独为孩子填写申请表格和另付申请费.

如果孩子是美国公民与您亲生的孩子,且美国未婚夫在米居住满5年,则孩子可自动成为公民,美国公民可直接到美领为孩子申请美国护照,直接与您去美国。否则,孩子不属于米国公民,需要为孩子单独填写申请表格和申请费,CR1不能自带回CR2。

申请国内CR1/CR2/IR1/IR2签证的条件:

1. 国内CR1/IR1签证的条件﹕

1) 中国申请人的配偶必须是美国公民,绿卡居民不能为中国配偶申请CR1/IR1签证;

2) 美国公民在中国工作或学习有中国居留证的;

2) 如果美国公民以前是通过婚姻移民取得的绿卡身份的,则必须满足下列三项条件之一:

a. 取得绿卡(条件绿卡或十年绿卡均可)满5年才能为新中国妻子申请CR1/IR1;

b. 或者,提供足够的证明,证明以前取得美国身份的婚姻是真实的,符合移民法;

c. 或者,提供以前取得美国身份的婚姻是由于配偶的死亡而结束的,即前配偶的死亡证明;

3) 美国公民愿意为中国申请者做经济担保,向美国政府保证负担中国申请人在美的生活,不给美国政府增加负担。

2. 中国申请者的未成年子女申請国内CR2/IR2签证的条件﹕

1) 中国申请者与美国公民结婚时,中国申请者的子女未满18岁;

2) 中国申请者的子女必须21岁以下且未婚。

3) 中国申请者收养的子女,收养关系需在养子女16岁前成立,并且中国申请人在拥有法定监护权的情况下与养子女生活两年以上,养子女必须21岁以下且未婚。

一、准备如下申请材料:

1.填妥的I-130;

2.G-325A你和美国公民一人填一份;

3.正面50*50照一人一张,背后签名;

4 出生公证1份,结婚公证复印件1份、公证1份;

5.双方的护照的复印件,(如果不方便自己复印,他们那给免费复印的);

6.申请费355美元。在大使馆里交;

7.美国公民的外国人居留证复印件;

8.中国配偶的出生公证一份

如果美国公民是入籍的,可能还要美国公民的入籍证书的复印件一份。

注意,移民局不在大使馆里,而是在附近的一个叫嘉里中心的写字楼里(移民局隶属DHS-国土安全部)。交钱还是在大使馆,所以你要两头跑,要交190美元,还需要美国公民的居留证。还有需要预约,不是到那儿就能进去的,所以你出发之前先打电话010-8529-6740,都是留言系统,座机打听的比较清楚,我用手机打的时候英语部分根本听不清,中文部分还可以。(同时使馆给的RECEIPT一定要留好复印件,那是曾经递交申请的唯一证明,务必好好保存。

二、几天后,你会收到U.S. Immigration and Naturalization Servise American Embassy Beijing 发来的信,告诉你,你的申请批准了。这个过程我用了7天。据我所知,在国内申请的人,都差不多这个时间。

三、再等些日子(我的是收到p2后的16天),你会收到p3,里面告知你的广州号码,签证类型等,里面还有230第一部分167,169,864,附加表等,你将packet3中的有关表格填好,赶快寄回美国驻广州领事馆,最好用EMS,将资料寄出后,你就可以办理未办好的证件,如:护照、护照相(正面)和签证相(侧面)若干,你们的合照、来往信件、电话单等,还有美国公民需要准备的的经济担保,总之是一切可以证明你们关系的材料。

四、几个个月后,就会收到美国驻广州领事馆寄的packet4。里面有体检表,家庭履历表,230第二部分,约见信,还有一些说明性表格。

五,面试带的材料:

一、 婚前准备

领结婚证所需材料:

中国公民的一方需要准备{==户口本==}和{==身份证==}

美国公民的一方需要准备{==护照==}和{==单身证明==}

另外带3张2寸的合影照片(就是背景是红色的那种结婚证专用照片)到中国公民所在地省会城市(或直辖市)民政局领取.

关于如何领取单身证明:

美国公民带上护照和居留证,前往大使馆,凭护照进入大使馆办理即可,不需要提前预约.(由于我是在大使馆外等候他的,所以不知道具体怎么操作的,但我想应该是很容易的,因为他20分钟就办完出来了,用了$30)

二、 领取结婚证

带齐材料后在民政局涉外婚姻办公室就可以直接办理了,我们花了¥300,但是速度还是比较快的.办完后他们直接建议我们去做公证了.公证时再交3张合影照片,以及所有办结婚证所需材料的复印件,等2、3天后就可以拿到结果了.

注意事项:结婚证只能在省会城市以及直辖市办理(可以打电话到你所在地的民政局咨询,他会告诉你应该在哪里领取)

结婚证的公证在任何一个城市都可以(针对象我一样住在非省会及直辖市的朋友来说,这点很重要,因为我就上了一当,没有回来公证,结果还要跑一趟武汉)

领单身证明时还需要中国公民的身份证复印件.对于不能和GG一起去大使馆领单身证明的JM,需要提供身份证复印件,或者直接把身份证给他带进去也可以.(我就是让他直接带进去的,由于单身证明上面需要写明他要和谁结婚,所以也需要女方的身份证明)

一、准备材料

(和喜九姐姐和其他姐妹们说的差不多,有一点不同)

(1)===I 130 表格一份,需GG填

(2)===G 325A 表格2份,你和GG各需要填一份

(3)===3/4 侧面照片,一人一张

(4)===结婚公证一份

(5)===非常多复印件.以下这些都需要复印.

GG的护照,居留证(绿卡),结婚证,结婚公证;我的身份证,护照,结婚证,包括上面说的填好的表格都需要复印.他们会保留复印件,但任然需要带原件去,他们会要求看.

注意事项:结婚证一定要把2个人的都带去,不要认为内容一样,就只带一个人的(象我一样,我们虽然顺利通过,但是被要求看我的结婚证了,好险)

二、申请程序

(1)===在预约时间前半小时到达北京美国大使馆附近的嘉里中心,美国 移民局在23层.

(2)===在经稍许等候后,在移民局窗口递交材料.在他们审核完原件后,会保留复印件,同时给你一张纸,然后告诉你拿着那张纸去美国大使馆交$355.由于大使馆离那里有大概200米远,所以叫GG一个人去即可,我仍留在那里等他.交完费,GG把收据交给他们,他们就会接受申请,并交给你一张收据,并嘱咐你要妥善保管这张收据,因为非常重要.至于怎么这么重要,我现在还不知道,反正留着就是了.

注意事项:一定要事先预约,切记!切记!

成都美领馆

准备材料:

⒈一份 I-130表

⒉老公老婆一人一份 G-325A表

⒊老公老婆一人一张50X50照 (后面写名字)

交资料后,美领事与美国公民谈话,了解美国公民到中国的时间情况,基本上是聊天而已.

不过对于国内申请CR1,我必须补充一点,按照我LG从上海美领馆拿到的check list,需要的东西应该如下:

广州-国内申请CR1的材料

申请材料:

⒈I-130, (直接在美国移民局网上下载可以用)

⒋出生公证1份,结婚公证1份, (公证处办理,有中英文翻译)

另外再出生证明原件,结婚证原件,出生公证1份,结婚公证1份,(用原件复印后,再逐字对照翻译,格式与公证处的不一样,再盖上领事馆认可的翻译章,我是在领事馆旁边的美佳移民公司做的,他们在美领前排队的地方有个30多平方米的平房,再过去100米左右有他们的第二个办公室,是在一栋大楼的第一层,最靠里面的一位女士做的,英文非常准确,当场有拿,100元一张,可有多份.)

⒌美国公民的护照原件,

⒍申请费355美元,在大使馆里交。

9.美国公民的出生纸原件

然后,移民官当场检验后,他们自己复印所需的材料,当场把我和我先生的护照原件,先生的居留证原件,先生的出生纸原件,我的出生证和结婚证原件退回.

如果双方曾经离婚,要离婚证的原件和公证书.

广州替老外办理居留证

在广州替老外办理居留证的条件是:

1.工作签证 Z签证; 老外可以以旅游签证进中国,再在国内转工作签证.

2.有关工作单位上级机构的批文,例如劳动局的批复,教育局的批文等.

3.批文必须是批准他在中国居留一年以上.

4.当地派出所的入住登记表.

如果居留时间不够1年,他们给的是临时居留证,一张浅绿色的纸片.

广州教育局有个麻烦,一般刚到中国工作的老师,就算学校出示1年合同,他们也只给半年的批文,这样老外只能在公安局拿到临时居留证.半年后再到教育局拿另外一张批文,到公安局换居留证.而且如果老外没有学士以上学位也不给批文。

但是政策是人定的,可以经常改变,我与他们打很多交道。不同的地方规定又不一样,我知道上海的公安局就没有一年的规定。

另外,如果老外离开中国只是暂时,在有效期内回中国,出中国海关的时候一定要小心,不要让那些懂一点又没有全懂的关员拿走居留证.

我在广州申请的时候只是在第一次递表的时候要出示居留证.以后再也没有查证了.

居住在国内的外国人如何报税

居住在国内的外国人用两个表报税,那2个表是IRS的报税表,1040就是通用的那个,2555表是用于那些在美国境外工作的人报税时填写的!以下连接,可以找到并打印此2个表格!填写好以后,按着IRS官方网页上的地址邮寄出去!

国内申请I-130的check list

STEPS ON TAKING AN I-130 PETITION:

1. go through the petition very carefully with this checklist.

2. make fee collection only when all supporting documents are present and all forms are completed. Please note that, the fee must NOT be collected under any circumstances if any of the requirements below are NOT met.

3. the petition should be received in the Immigration office, Beijing, by official mails. All petitions sent directly from the petitioners will not be accepted.

1. Form I-130(the following items must be completed)

* Name of the beneficiary must be the same as the one in the passport. Any other names used should appear in item 7 of Part C (Other Names Used, including maiden name)

* Item 11 of both Part B and Part C(Names of Prior husbands/wives) must be filled out. If not applicable in this case, please write “N/A”.

* Item 18 of Part C (Address in the United States where your relative intends to live) must be completed.

* In Item 20 of Part C (If your relative’s alphabet is other than Roman letters, write his or her name and foreign address in the native alphabet), please write in Chinese characters the beneficiary’s name and address(if the beneficiary is a Chinese citizen).

2. Copy of the fee collection receipt($130.00).

3. Certified copy of the petitioner’s valid U.S. passport(the biographic page and the expiration date of the passport).

4. Certified copy of the petitioner’s “Z” visa of China or the Foreigner’s Residence Permit(the little green book) and working permit(the brown book). Please make sure that all documents are valid when the petition is filed.

5. Notary of the marriage certificate(if married in China) or certified copy of the marriage certificate(if married in the U.S. or other places).

6. Proof of legal termination of all previous marriages(i.e. divorce decree and/or death certificate), if applicable. The divorce decree must be notarized if divorced in China, and a certified copy is needed if divorced in the U.S. or other Country with certified translated copy.

7. Form G-325 A for both the petitioner and the beneficiary (4 copies for each, must be completed and signed)

For the item “Applicants employment last five years. (If none, so state) list present employment first”:

a please note that the employment also includes the studies. If the applicant(either the petitioner or the beneficiary) was a student during a certain period in the last five years, please list the name and address of the school, and specify the occupation as “student”.

b if the applicant is now staying at home as a housewife, please also list it and specify the occupation as “housekeeper”.

c the time frame for each occupation should be continuous.

8. ADIT photo for both the petitioner and the beneficiary (1 for each, white background, show the right part of the face and the right ear).

9. Certified copy of the beneficiary’s valid passport(the biographic page and the expiration date of the passport).

I-130 petition for step-children

A separate petition is needed if the petitioner is filing for both the spouse and the stepchild(the child should be under 16 years-old when they get married). In this petition for the child, all documents should be arranged as the same as the petition for the spouse. In addition to that, a notary of the child’s birth certificate must be included in the petition. Another fee ($130) should be collected and a copy of the receipt attached.

IMPORTANT, PLEASE NOTE:

All supporting documents, if in foreign language, must be accompanied with a certified translation in English.

I-130 (Immediate Relative Petition) PROCESSING AT INS/BEIJING

1. Effective immediately, INS/Beijing will accept and process Form I-130, Petition for Alien Relative, from American citizens resident within the jurisdiction of this office. As with Forms I-600A, prospective petitioners must show evidence of residency through presentation of a Foreigner’s Residence Permit or long-term work(“Z”) visa. INS/Beijing will also accept properly prepared Forms I-130 from constituent posts in Shenyang, Shanghai and Chengdu.

2. INS/Beijing will only accept Forms I-130 for prospective beneficiaries for whom priority date are current. Thus, petitioners may only file for spouses and minor children under age 21.

3. Form I-130 must be accompanies by the following:

* Fee receipt for $ 130.00 USD

* Proof of U.S. citizenship of the petitioner

* Proof of identity for prospective beneficiary (i.e. copy of passport or notarial birth certificate)

4. Proof of relationship:

* MARRIAGE:

? Marriage certificate (must be notarized certificate if married in China)

Proof of legal termination of all previous marriages (i.e., divorce decree and/or death certificate), if applicable.

直接领事馆申请时有关收入不足、无固定住所和无税单的一个问题

DCF-Direct Consular Filing

Q:I am an American citizen and I have been living in China for the past three years with my fiancée. I have been mostly on short term business and tourist visas. We would really like to move to the US in the next 12-18 months and give life a shot in my home country.

We are not married yet as I thought a fiancée visa would be more appropriate but I was recently told that a DCF might be a quicker option.

I do not have tax records for the past three years as I have not been in the US ( I have been told that I need to back file, although I have almost no income), but I do have willing and able joint-sponsors.

I also do not have my own residence in the US I was living with my father before coming to China, but he lives in housing which might or might not permit my (soon to be) wife from living there. We plan to travel a bit before choosing our own area of the country any way, but I am not sure if the rules of my father’s residence will come into play at all when my petition is being reviewed.

We are prepared to marry now if it will help us get to the US sooner or with less hassle. I personally would like to be able to go home so to speak after years abroad.

Is DCF an option or a better option for us?

Any thought and advice regarding our tax and housing situation?

A:The first thing to find out is if you have the appropriate residency in China to be eligible to file your petition there. Check the Consulate's website under Immigrant Visas (or, USCIS may have an office there--you would file with them, not the Consul).

There is at least 1, maybe 2 people in this forum who are filing DCF in China, so have a look back at their posts.

Being outside the US is not sufficient reason to not file your US tax returns. I suggest you look into that soon, as that will affect any future filing. If you owe no tax, there is no penalty for not filing. The IRS staffs are actually friendly and give correct advice; you will find local help on the Consulate's website.

Your flexible plan on return will not be helpful to your spouse's immigration. You will be expected to be domiciled in the US as part of sponsoring her, and will want to show a place to move to, banking, voting, employment etc as part of establishing/showing domicile.

DCF is the preferred situation for you, as it is for any USC living abroad. The petition + visa process is somewhat flexible and I have experienced and read many creative solutions, so don't be discouraged. Your spouse will appreciate the benefits of entering the US with an immigrant visa -vs- a K1 as she will not have the AOS hassles to add to the 'interesting times' of moving to a new country. It will also start her clock toward naturalization all the faster, should she be interested. I have a feeling that she might like getting married in China better than in the US, too

Have you read the DCF Guide here, to get a feel for the flow? Look for bjjenney's posts here (just search DCF forum for China in case there is another one..) and see what the Consulate's page says about IVs. Let us know if you have any Qs, but I think that in the whole, especially if you have a willing Joint Sponsor, that DCF will be a good solution for you.

A:Sorry, I don't check in here often enough these days! Meauxna is right - first thing is making sure you have a residence permit. Then you make an appointment with the USCIS office if you're in or near Beijing or else the consulate near you can help. Then it's very fast, so yes, it's the best way to go.

Don't worry about the "domicile". If you've got someone like your dad able and willing to be co-sponsor, you should be fine. The whole point is for people living overseas and they know on a Chinese salary that's a hard requirement to meet! Also, one thing is to show continued "ties" to the US, like return trips and so on.

My husband should have interview soon, so we will actually see then how easy this will be, but I don't anticipate probes with a co-sponsor.

2.1  出生证公证书 or 出生公证书

2.2  结婚公证书 or 结婚证公证书

2.3  历次离婚公证书(适用于有离婚史的)

2.4  未刑公证书

2.5  国外警方证明 (从未出国或在国外某国连续居住不满一年者免)

如果有CR2/IR2:(每位CR2/IR2同)

2.6  出生证公证书

2.7  如果CR1/IR1的离婚证公证书/离婚公证书上没有注明拥有CR2/IR2的抚养权,需要单独办理小孩的抚养权公证书 (18岁以上CR2/IR2免)

2.8  未刑公证书 (16岁以下免)

2.9  国外警方证明 (从未出国或在国外某国连续居住不满一年者免)

2. 面试预约英文信(复印件也可以);

3. 体检表;
